The Eu’s area of freedom, security and justice facing obstacles in surrender and extradition proceedings

The final conference of the EuroLegalBot project will take place on 19 November in Venice, from 9.00 am to 6.00 pm. It will bring together judges, partners and project leaders to discuss the challenges involved in applying extradition procedures within the European Union, including:

  • Federico Cappelletti – Lawyer in Venice and co-chair of the Observatory on European Law of the Union of Italian Criminal Chambers – will outline the challenges and opportunities of using AI in criminal proceedings for legal professionals.
  • Sergio Bianchi – Director of Agenfor International Foundation – will present the chatbot designed for legal professionals.
  • Paola De Franceschi – Judge at the Venice Court of Appeal – will explain how the mechanisms for judicial cooperation in criminal matters are based on the principle of mutual recognition of judicial decisions.
  • Stefano Opilio – Deputy Public Prosecutor in Rome, former Director-General of the Department of International Affairs at the Italian Ministry of Justice – will explain how requests from Member States of the European Court of Human Rights and third countries are handled in extradition proceedings – respect for the ‘rule of law’ and the procedural rights of the accused, assessment of the strength of the evidence, dual criminality, ne bis in idem.
  • Gianfranco Criscione – Judge at the Milan Court of Appeal – will address the refusal of extradition and the recognition of foreign judgements: legal basis (international conventions and provisions of the Code of Criminal Procedure) and a comparison with the European arrest warrant procedure.
  • Nicola Canestrini – Criminal defence lawyer specialised in international criminal cooperation, qualified to appear before the International Criminal Court – will outline the shortcomings in Italian and European law regarding extradition.

Remote participation will also be possible.
