“Critical Legal Issues in the Application of the European Arrest Warrant: Active and Passive Perspectives as a Legal Framework for AI Training”
Paola De Franceschi – Judge at the Court of Appeal of Venice.

This presentation took place within the framework of the 2nd Steering Committee meeting of the EuroLegalBot project, held on 20 February 2026 in Paris (hybrid format). It formed part of the activities of Work Package 4 – Piloting, which focuses in particular on the integration of legal dimensions into artificial intelligence tools applied to the judicial field.

The European Arrest Warrant remains a key instrument of judicial cooperation in Europe.

The issues identified – judicial oversight, respect for fundamental rights and proportionality – are central to current discussions, particularly in the context of the development of innovative tools related to artificial intelligence.

This presentation fits within this broader context and takes on particular significance within the framework of the EuroLegalBot project, led by the Court of Appeal of Venice. This leadership role reflects the commitment of European judicial authorities to developing technological solutions tailored to real judicial practice.

In this context, the tools developed within the project stand out for their approach: they are designed in close collaboration with legal practitioners, ensuring their relevance, reliability and compliance with legal requirements.

The objective is therefore to contribute to a tangible improvement in the efficiency of justice, by integrating technological advances while preserving the fundamental principles on which it is based.
